Refund policy
Due to the perishable nature of our products and for public health and food safety reasons, all food sales are final. We do not accept returns or exchanges except as expressly outlined below.
Eligibility for Refunds or Replacements
A refund or replacement may be considered only under the following circumstances:

The product arrives damaged, spoiled, or defective at the time of delivery

The issue is reported to Caviar & Caviar within 24 hours of delivery
-
The product and all original packaging are retained and available for inspection
Claims submitted after 24 hours from delivery are not eligible for review.
Non-Returnable Items
The following items are not eligible for return, refund, or exchange:

Opened or partially consumed food products

Products returned without original packaging
-
Products returned due to personal preference, taste, or improper storage after delivery

Products delayed or damaged by the shipping carrier once accepted for transit
Returned food products cannot be resold and must be discarded in accordance with food safety regulations.
Refund Method
If a claim is approved:

Refunds will be issued only for the purchase price of the product

Shipping and handling fees are non-refundable
-
Refunds will be processed to the original form of payment
Alternatively, at our discretion, a replacement product may be issued instead of a refund.
Shipping Issues & Carrier Claims
Caviar & Caviar uses temperature-controlled packaging to ensure product integrity during transit. Once an order has been handed off to the shipping carrier, any damage caused during transportation must be addressed directly with the carrier, in accordance with their claims process.
Customers must notify both the carrier and Caviar & Caviar immediately if a package arrives damaged or tampered with.
Inspection Requirement
Customers are responsible for inspecting their shipment immediately upon delivery. Failure to do so may void eligibility for a refund or replacement.
Price Changes
All prices are subject to change without prior notice. Refunds, if approved, will be based on the original purchase price paid.
Caviar & Caviar conducts its business in compliance with the Florida Food Safety Act, U.S. Food and Drug Administration (FDA) regulations, and all other applicable federal, state, and local food safety laws and regulations.
Our corporate mission is to safeguard public health and promote public welfare by protecting consumers from injury related to product use and from harm arising from misleading or deceptive merchandising practices.
Packaging & Transportation
Caviar & Caviar uses secure, temperature- and humidity-controlled packaging systems to ensure safe transportation of our products to their destination.
Any damage incurred during transportation must be addressed directly with the shipping carrier, in accordance with the carrier’s specific claims policy.
Final Sale Policy & Food Safety
To prevent risks associated with spoilage, contamination, or misbranding, food products that have been returned cannot be resold and must be discarded.
For public health and safety reasons, all food sales are final. No returns or exchanges will be accepted except as expressly outlined below.
Workplace Hygiene
Caviar & Caviar maintains strict workplace hygiene standards, including providing tissues and no-touch disposal receptacles for employees and ensuring that soap and water are readily available and prioritized for handwashing.
Delivery Disclaimer
All delivery dates are estimates only.
Caviar & Caviar shall not be liable for any damage, loss, or failure to deliver resulting from delays or circumstances beyond its control, including but not limited to:

Supplier issues

Government actions, regulations, or embargoes

Fire, flood, accidents, sabotage
-
Labor disputes, strikes, or slowdowns
-
War, riots, or civil disturbances
-
Transportation delays or carrier defaults
In the event of a delay, the delivery date shall be extended by a period equal to the delay.
The buyer’s exclusive remedy for Caviar & Caviar’s inability to deliver for any reason shall be rescission of the agreement, which may only be exercised prior to delivery of the product to the shipping carrier.
Entire Agreement & Governing Law
Acceptance of Caviar & Caviar’s terms and conditions constitutes the entire agreement between Caviar & Caviar and the buyer.
No term or provision of this agreement may be amended, waived, or terminated except by a written instrument signed by all parties, unless otherwise expressly stated herein.
This agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
The parties irrevocably submit to the jurisdiction of any state or federal court located in Broward County, Florida, and waive any objection based on inconvenient forum.
In the event of a dispute arising from this transaction, the unsuccessful party shall be responsible for all costs and expenses incurred by the prevailing party, including reasonable attorneys’ fees.
Returns and Exchanges
All merchandise is guaranteed to be fresh and must be inspected immediately upon delivery.
If a quality-related issue is identified, customers must notify Caviar & Caviar and return the product within 24 hours of delivery to be eligible for either:

An exchange, or
-
A refund of the product purchase price only (excluding shipping and handling fees)
All original packaging must be retained and returned intact.
If an unopened and unused item is returned for store credit, a 20% restocking fee will be deducted from the product value.

Delays in reporting damage may compromise the ability to file a successful claim.
